Terms of Service

Acceptance of Terms

By downloading, installing, or using StillNote (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Age Requirement

You must be at least 18 years of age, or the legal drinking age in your jurisdiction (whichever is greater), to use StillNote. By using the Service, you represent and warrant that you meet this requirement.

Description of Service

StillNote is a digital whiskey tasting platform that allows hosts to create tasting sessions and guests to record tasting notes, scores, and session results. The Service is provided by an individual developer operating under the name StillNote.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide a valid email address and may not impersonate any person or entity. We reserve the right to terminate accounts that violate these Terms.

Subscriptions and Payments

PricingStillNote offers a free tier and paid plans including a Single Session Pass ($24.99) and an Annual Unlimited subscription ($89.99/year). Prices are subject to change with reasonable notice.
BillingSubscriptions are billed through the platform you purchased on -- Apple App Store, Google Play, or Stripe (web). Billing is managed by RevenueCat. By subscribing, you authorize the applicable payment processor to charge your payment method on a recurring basis until cancelled.
CancellationYou may cancel your subscription at any time through your device settings (iOS/Android) or, on web, the “Manage subscription” link on your Dashboard, which opens your subscription management page. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
RefundsRefund requests for App Store purchases are handled by Apple. Refund requests for Google Play purchases are handled by Google. For web purchases, contact us within 14 days of purchase and we will review your request.

Acceptable Use

You agree not to:
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Upload or transmit harmful, offensive, or infringing content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service in a way that could damage, disable, or impair it

Intellectual Property

All content, branding, and software comprising the Service are the property of StillNote or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service to organize, host, and participate in tasting sessions, including a tasting you host as a paid or professional event. This license does not permit reselling, white-labeling, rebranding, sublicensing, or otherwise commercially exploiting the Service itself as your own product or platform, except where expressly authorized under a separate Distillery or Corporate agreement.

User Content

You retain ownership of the tasting notes and session data you enter into the Service. By using the Service, you grant us a limited license to store and display your content solely to provide the Service to you. We do not share your tasting data with other users without your consent.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STILLNOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Maryland.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, where appropriate, notify you by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
